Service Agreement
1. Services Provided: New Braunfels Balloon Bar agrees to provide the balloon
decor services listed on the quote/invoice as requested by you, the customer.
2. Payment terms:
Deposit: A 50% non-refundable deposit is required upon acceptance of our quote to secure your event date.
Final Payment: The remaining balance is due two (2) weeks before the event.
Please pay full amount if your event date is less than 2 weeks away.
3. Cancellation Policy:
Customer Cancellation: If the customer cancels the event, the deposit will NOT be refunded. This is because we purchase the balloons and materials in advance to prepare for your event. Since these items are custom ordered, we are unable to offer refunds if the event is canceled.
New Braunfels Balloon Bar Cancellation: In the event New Braunfels Balloon Bar cancels due to unforeseen circumstances, all payments made by the Customer, including the deposit, will be fully refunded.
4. Setup
Access to Venue: To ensure adequate time for setup, the customer agrees to arrange access to the event venue for New Braunfels Balloon Bar at least 2 hours prior to the event start time unless discussed otherwise.
Setup Conditions: New Braunfels Balloon Bar shall perform all setup services for the balloon decor in accordance with the agreed design. New Braunfels Balloon Bar reserves the right to make adjustments to the setup if any unforeseen limitations arise at the venue (e.g., ceiling height, wall restrictions, or safety requirements).
5. Breakdown
The customer agrees to pop and dispose of all balloons after the event and prepare all rented backdrops, poles or other installation items to be ready for pickup by New Braunfels Balloon Bar at the agreed upon pickup time. The customer may keep the balloons instead of popping simply by detaching the balloons from any rented backdrops, poles or other installation items before pickup.
Strike Fee: In the event that New Braunfels Balloon Bar is required to return to the event location outside of the originally scheduled breakdown time to remove the balloon decor, a strike fee will apply. The strike fee will be charged to cover the additional time, labor, and transportation costs associated with returning to the venue.
A Strike fee will also occur if the customer chooses to have New Braunfels Balloon Bar POP and dispose of the balloons. The strike fee is typically $100. New Braunfels Balloon Bar will inform the customer if a strike fee will be applied and will provide an itemized invoice for any additional charges incurred.
6. Grab-N-Go / You pick up and hang (Garlands, Freestanding Garlands, Party Poles, Columns)
Pick up: The customer agrees to pick up Grab-n-Go garlands, freestanding garlands, party poles and columns at the location arranged after ordering. Pick up times will be scheduled by New Braunfels Balloon Bar.
Return: The customer agrees to return all hardware items such as poles used to make the decor to the same location as pickup. All items must be returned no longer than 5 days after the event or an additional fee of $25 for each item will be charged. The customer may keep the hardware (pole) items for $20 each if agreed upon and paid for before the event.
7. Customization:
A PDF File must be provided to New Braunfels Balloon Bar at least seven (7) days before the event. If provided in less than 7 days, a $25 fee per item (such as a party pole) will apply. If the PDF file is not provided within 48 hours of the event, New Braunfels Balloon Bar will not customize your balloon order and there will be NO REFUND for customization paid on your invoice. If you do not have a Vector or PDF file, there will be a $50 fee to create it.
Limitations of Liability

Weather Conditions: New Braunfels Balloon Bar shall not be held liable for any disruptions, damages, or losses caused by adverse weather conditions, including but not limited to wind, rain, heat or cold that may impact the balloon decor during the event. We will take reasonable precautions to secure the balloon setup; however, we cannot be held responsible for any weather-related incidents.

Children Safety: The customer acknowledges that balloons can present choking hazards to children. While we take every precaution to secure balloon installations, it is the responsibility of the customer to ensure the safety of all attendees, especially children, during the event.

Balloons Popping: New Braunfels Balloon Bar will make every effort to provide high-quality and durable balloons. However, the customer acknowledges that balloons are susceptible to popping and accidental damage during the event. We will not be held liable for any incidents related to balloon popping or accidental damage.

Allergic Reactions: New Braunfels Balloon Bar shall not be held responsible for any allergic reactions caused by balloon materials or other substances used during the event. The customer is responsible for notifying us of any known allergies among event attendees.

Third-Party Services: In the event that the customer requests additional services or products from third-party vendors, New Braunfels Balloon Bar shall not be liable for any issues or disputes arising from the services or products provided by these vendors.

Event Venue Restrictions: New Braunfels Balloon Bar shall not be held liable for any limitations or restrictions imposed by the event venue that may affect the balloon decor setup or overall design.

Customer's Approval: The customer acknowledges that they have reviewed and approved the final balloon decor design before the event. Any changes or modifications requested during or after the event may be subject to additional charges and may not be feasible to execute.

Delays or Force Majeure: New Braunfels Balloon Bar shall not be liable for any delays or non-performance of services caused by unforeseen circumstances beyond our control, including but not limited to natural disasters, accidents, acts of God, labor disputes, or other force majeure events. Furthermore, New Braunfels Balloon Bar is not responsible for damage to the balloon décor after it has been set up, including damage caused by weather, venue staff, guests, or other external factors. The Customer is responsible for ensuring that the balloon décor remains intact and undamaged throughout the event. Any damage caused by the Customer or event attendees may result in additional charges for repairs or replacements.

Indemnification: The Customer agrees to indemnify and hold harmless New Braunfels Balloon Bar, its employees, and agents from any and all claims, damages, losses, and expenses arising out of the Customer’s event, except for those resulting from the negligence or misconduct of New Braunfels Balloon Bar.

Photography and Marketing: The Customer agrees that New Braunfels Balloon Bar may take photographs of the balloon décor at the event and use them for marketing purposes, including on social media, websites, and promotional materials.
By accepting this quote/invoice, the Customer acknowledges and agrees to the above service agreement and limitations of liability set forth by New Braunfels Balloon Bar. Please read this document carefully and contact us if you have any questions or concerns before making payment.
